RISICO’S EN KANSEN OP HET GEBIED VAN WAARDEONTWIKKELING

De eigenaar loopt het bedrijfsruimte huren in Amsterdam risico op waardevermindering en heeft de kans op waardevermeerdering op enig moment. In het geval van koop ligt zowel het risico als de kans dus volledig bij de gebruiker. Als er gehuurd wordt, is doorgaans voor een periode van vijf tot tien jaar een periodieke huursom overeengekomen, die jaarlijks wordt geïndexeerd op basis van de kantoorpand te huur in Arnhem consumentenprijsindex. Als er in het algemeen sprake is van een positieve waardeontwikkeling op de vastgoedmarkt en van stijgende huren, zal de huurder bij het afsluiten van een nieuw contract worden geconfronteerd met hogere lasten. Volgens dezelfde redenering heeft een negatieve waardeontwikkeling als consequentie dat een lagere huur zal worden berekend bij een nieuw contract. In deze optiek bestaat er met betrekking tot de kansen en risico’s van waardeontwikkeling een inverse relatie ten opzichte van de eigenaar: de huurder loopt het risico van waardevermeerdering en heeft de kans op waardevermi nderi ng.
Ten opzichte van huur zijn voor operational lease twee verschillen relevant. Ten eerste gaat het om een langere contractduur, waardoor een eventuele

tussentijdse waardevermindering of -vermeerdering niet kan worden verwerkt in de leasetermijn. Daarnaast is er sprake van een koopoptie, waarmee de lessee dus recht heeft op het incasseren van een eventuele waardevermeerdering, zonder het risico te lopen op een waardevermindering. Het verkrijgen van kansen en het afwentelen van risico’s heeft echter altijd een prijs. Er zal dus per saldo een winkelpand te huur Tilburg  hogere leaseprijs worden betaald voor een contract met koopoptie dan voor een contract zonder die optie. Onmiddellijk rijst dan de vraag of dit geld niet beter had kunnen worden geïnvesteerd in het primaire proces van de gebruiker…
